Terms and Conditions, Delivery, Returns and Cancellation Policy  

These Terms and Conditions govern the sale and supply of products ("the goods") by Best Rhone Wines ("the company") to customers ("the Customer") for delivery within the United Kingdom via Best Rhone Wines online shop. 

Definitions
In these Terms and Conditions the following words shall have the meaning set out opposite them:
  1.  “the Company” shall mean Best Rhone Wines 
  2. “the Customer” shall mean any person, firm, company or organisation from whom or from which the Company accepts an Order to supply Goods
  3. “the Goods” shall mean wines and products made available for sale via the online store and through the website
  4. “the Order” shall mean the order placed on the Company by the Customer via the online store for the supply of Goods 
  5. “working day” is 0900 to 1700 (GMT) Monday to Friday, excluding bank holidays and public holidays.
  6. “Confirmation Email” means an email communication from Best Rhone Wines confirming its acceptance of an Order from the Customer, which will contain an estimated date of delivery and a unique reference number;
  7. “Contract” means the contract for the purchase and supply of Products between the Customer and Best Rhone Wines, which is formed on acceptance of an Order by Best Rhone Wines

General 
  • Only persons over the legal age, in their country of residence, may access or purchase Goods from the website. By making a purchase via the online shop, the Customer warrants that he or she is of legal age to purchase alcohol in his or her country of residence.
  • By accessing the website the Customer agrees to be bound by these Terms, which will be updated from time to time at Best Rhone Wines sole discretion. Individuals who are not prepared to agree to be bound by these Terms do not have permission to access or use the Website.
  • Orders will be placed via the Company’s website, and in such circumstances the website terms and conditions will apply.
 
Orders
  • Best Rhone Wines will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18, and reserves the right to refuse to accept an Order in its sole discretion if it has reason to believe the Customer is under 18, or the Customer intends to supply Goods to under-18s. By placing an Order the Customer confirms that he or she is at least 18 years old.
  • Minimum order 6 bottles, wines are sold in multiples of 6 bottles
  • A flat shipping rate, to a UK address, of €18 per order (minimum 6 bottles) is added to the cart once the customer has entered an address
  • Each Order placed by a Customer shall be deemed an offer and shall be subject to acceptance by Best Rhone Wines by a Confirmation Email. Best Rhone Wines may refuse to accept an Order for any reason, and Customers should note an on-screen acknowledgement of an Order does not constitute acceptance by Best Rhone Wines . On receipt of a Confirmation Email, the Customer shall become bound by these Terms.
  • If an Order cannot be accepted for any reason (including for example but without limitation non-availability or withdrawal of a Product) Best Rhone Wines will notify the Customer via email and, wherever possible, offer a replacement or a refund as appropriate.
  • All Orders are subject to Best Rhone Wines receipt of a valid debit or credit card authorisation from the Customer. Full payment for the Goods is to be made at the time an Order is placed.
  • Supply to a Customer of the Goods shall not pass until full payment has been made for the Goods at the price specified in the relevant Confirmation Email. In any case of non-payment or chargebacks by a Customer, the company shall be entitled to repossess or trace the Goods or the proceeds of sale 
  • In respect of all Orders shipped, the risk in the Goods shall pass to the Customer immediately on delivery.

Price and Payment
  • All prices are quoted inclusive of VAT and other applicable taxes relating to the sale or delivery of the Goods, unless specified otherwise.
  • All prices quoted in the Company’s publications are subject to alteration or withdrawal without notice, are quoted in euros €, and may be per bottle or per case.​
  • Delivery charges shall be in addition to the price quoted per bottle or per case or offer, unless otherwise stated. 
  • Promotional offers and prices are as stated, with no further discounts available.
  • Every effort is made to ensure the published price of each Good is accurate, Best Rhone Wines cannot guarantee pricing will be correct in all circumstances or that all Goods in the online store will be available at all times. In the event of a pricing error, Best Rhone Wines will either contact the Customer to offer the option of a replacement, a refund or fulfilment of the Order at the correct price. Best Rhone Wines will not in any event be obliged to supply Goods at an incorrect price.
  • Best Rhone Wines reserves the right to adjust prices and offers on Goods at its discretion before acceptance of an Order. Where an end date for an offer is specified on the online store it is intended for guidance purposes only.

Delivery/Shipping
  • The price of delivery shall be quoted on the quotation and the Confirmation email and shall be part of the total price quoted to the Customer.
  • Minimum order 6 bottles. Wines are ordered in multiples of 6 bottles. Wines are delivered to your door directly from the Rhone valley.
  • Delivery usually takes 5-7 days. 
  • A flat shipping rate, to a UK address, of €18 per order (minimum 6 bottles) is added to the cart once the customer has entered an address 
  • We deliver worldwide, for delivery charges outside the UK please contact us    ​
  • The Company will deliver the Goods to anywhere in the United Kingdom (except Northern Ireland, the Highlands, Scottish islands, the Isle of Man and the Scilly Isles.). Delivery will be made to the address specified by the Customer at the time of placing the Order. The Company reserves the right to make delivery in instalments. If the Company elects to do this, there will only be a single delivery charge.
  • Delivery will normally take place within 7 working days of the date of the Confirmation email. The Company will make every reasonable effort to deliver the Goods within 7 working days, and unless it is otherwise agreed in writing, the Customer shall not be entitled to cancel the order in whole or in part on the grounds of delayed delivery howsoever caused, nor shall the Customer be entitled to claim damages or compensation. In the event that the Company is unable to make delivery within 7 working days, the Company will contact the Customer and keep the Customer updated accordingly.
  • If the Customer is not available at the time of delivery, the Company’s delivery agents will leave the Goods in a safe place, provided that the Customer has provided such instructions to the Company at the time of placing the Order. Alternatively, the Company’s delivery agents will leave a card requesting the Customer to arrange a more convenient delivery time.
  • All Goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted, the Goods may be retained by the delivery agent, in which case the delivery agent will leave notification of attempted delivery and will telephone to rearrange or will return later that day. In these circumstances, if the Company has to re-deliver the goods, a further delivery charge may become due and payable by the Customer.
  • The Company reserves the right to use any method of transport for delivery, and the Goods shall be at the risk of the Company during transit.
  • A clear receipt for the Goods shall be sufficient evidence that the Goods have been delivered in good condition.

Returns and Cancellation
  • The Customer has a legal right, under the Consumer Contracts  Regulations 2013, to cancel the Contract within fourteen (14) days after the date the relevant Order has been accepted. However, Best Rhone Wines is only obliged to reimburse the cost of returning items where they were delivered in error, or the Goods were damaged or defective. 
  • The Company reserves the right to cancel any uncompleted order, or suspend delivery, if the Purchaser fails to observe or perform any obligation on the part of the Purchaser to be observed and performed, or if the Company reasonably believes that in all the circumstance that the Purchaser may do so. 
  • Should the Customer elect to cancel an Order, all charges will be refunded within fourteen (14) days of the Goods being returned, provided they are in a saleable condition. The Customer must make arrangements for the collection of the Order within fourteen (14) days of notifying Best Rhone Wines of its intention to cancel the Contract, failing which Best Rhone Wines may decline to accept the Goods or process the Customer’s refund request. 
  • If the Customer wishes to exchange  Goods, additional shipping charges may apply together with the difference (if any) between the prices of the original and the replacement Goods. 
  • Best Rhone Wines will provide a full refund or replacement for any Goods which are defective or not as described. In such event, the Customer has a period of thirty (30) days, starting from the date of delivery of the Order, to reject any Goods contained in the Order. This condition does not affect the Customer’s statutory rights.

Liability
  • ​Any of the Goods which the Customer claims to be defective, will be replaced or (at the Company’s option) the price of the defective Goods will be credited to the Customer and the Company will pay the expenses of such return.
  • The Company shall not be liable for a breach of the warranty if:
                -the Customer makes any further use of such Goods after giving such notice
                -the defect arises because the Customer failed to follow the Company’s written instructions as to the storage, installation or use of the Goods
                -the Customer causes loss or damage during the handling of the Goods
  • All other warranties, conditions and other terms implied by Statute or Common Law are, to the fullest extent permissible by law, excluded from this Order.
  • The Company’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this Order shall be limited to the total Order price.
  • Notwithstanding anything contained in this Order, the Company shall not be liable for any indirect, special or consequential loss or damage suffered or incurred by the Customer arising out of this Order. For the avoidance of doubt, indirect, special or consequential loss shall include, but not be limited to, loss or damage, loss of profits, interest, business, goodwill, revenues or anticipated savings and the incurring of liability for loss or damage suffered by third parties (including in each case incidental and/or punitive damages).
  • The online store is only intended for the sale of Goods for domestic and private use. The Customer agrees that he or she will not use the Goods for any commercial, business or re-sale purposes
  • In the case of non-delivery of the whole Order, claims must be submitted in writing to Best Rhone Wines within seven (7) working days of receipt by the Customer of notification of despatch of Goods.  In the absence of notification of claims within the terms mentioned above the Products shall be deemed to have been delivered in accordance with the Customer’s Order.
